1. Scope of Services
These Terms and Conditions govern the provision of professional audio recording, mixing, mastering, and podcast production services provided by Yahasehonoperations Pty Ltd, directed by Benjamin Clarke. By requesting a booking via our contact form, the client agrees to be bound by these terms.
2. Booking and Reservations
All bookings are subject to availability. A reservation is considered confirmed only after the payment of the required deposit. For safety and insurance reasons, clients under the age of 16 must be accompanied by a legal guardian at all times while on the premises at 114 Gawler Place, Adelaide.
3. Pricing, GST and Payments
All rates listed on our services page are inclusive of 10% GST (Goods and Services Tax). Payments are processed in AUD. For corporate clients (B2B), invoices are issued upon completion of the session and must be settled within 14 days of the invoice date.
4. Cancellation and Deposits
To secure a session, a deposit of 25% of the total estimated cost is required. We offer a flexible cancellation policy: bookings may be cancelled or rescheduled without penalty up to 3 days before the scheduled start time. Cancellations made within this 3-day window may result in the forfeiture of the deposit.
5. Revisions and Delivery
For mixing and mastering services, the client is entitled to 3 rounds of revisions. Any additional changes requested beyond this limit will be billed at our standard hourly rate. Final files are delivered in WAV and MP3 formats as specified in our file formats guide.
6. Intellectual Property Rights
Yahasehonoperations Pty Ltd acknowledges that the artistic content belongs to the client. However, the legal transfer of the master recording rights and the delivery of high-resolution stems occur only after 100% of the project fee has been paid. The client warrants that they hold all necessary rights to the compositions and performances recorded.
7. Liability and Conduct
Clients are responsible for any damage caused to studio equipment through negligence or misuse. Our liability is limited to the total amount paid for the specific session in question. All studio photos used on our website are illustrative.
8. Governing Law and Disputes
These terms are governed by the laws of South Australia and the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Any disputes that cannot be resolved through direct communication with Benjamin Clarke shall be subject to the exclusive jurisdiction of the courts in Adelaide.
